Many people have paid thousands of pounds for care before ever finding out about CHC funding. Assessments may have been completed without their knowledge or involvement, or simply never carried out at all.

In many cases, we act for families whose relatives have passed away. They have often used their life savings or sold their home to fund their care, unnecessarily and unfairly. Thankfully, it is possible to recover these costs retrospectively.

Successful retrospective claims depend on the presentation and analysis of a huge amount of information, from historical care and medical records. Because the process is time-consuming and laborious, instructing a professional to assist you can be invaluable.

Our approach…

The main steps involved in our Retrospective Reclaims Service:

  • Our team of experts will obtain necessary care and medical records for the enquiry period and conduct a screening exercise to determine the merits of the claim
  • If we believe your relative may have been eligible for CHC funding for all or part of the period, we will offer to pursue this on a “no win no fee” basis. You only pay us if we are successful
  • We deal with all aspects of the assessment and appeal process
  • If CHC funding is awarded retrospectively, we will calculate the reimbursement owing, including interest payments, and negotiate a settlement with the ICB to ensure the maximum entitlement is refunded

People often miss out on funding in many circumstances, including:

  • Being discharged from hospital straight into a care home
  • Those who were subject to assessment and found not eligible, but never reassessed as their condition worsened
  • Those who received Funded Nursing Care (which pays for the nursing element of their care), but were never assessed for CHC funding
  • More affluent patients who assumed they would have to pay. NHS Continuing Healthcare Funding is not means-tested: if you qualify, all your care is funded by the NHS
