Retrospective Reclaims Service

Reclaim wrongly paid care fees

Did you know you can reclaim care fees retrospectively, going back as far as April 2012?

Many people have paid thousands of pounds for care before ever finding out about CHC funding. Assessments may have been completed without their knowledge or involvement, or simply never carried out at all.

In many cases, we act for families whose relatives have passed away. They have often used their life savings or sold their home to fund their care, unnecessarily and unfairly. Thankfully, it is possible to recover these costs retrospectively.

Successful retrospective claims depend on the presentation and analysis of a huge amount of information, from historical care and medical records. Because the process is time-consuming and laborious, instructing a professional to assist you can be invaluable.

Our approach…

The main steps involved in our Retrospective Reclaims Service:

  • Our team of experts will obtain necessary care and medical records for the enquiry period and conduct a screening exercise to determine the merits of the claim
  • If we believe your relative may have been eligible for CHC funding for all or part of the period, we will offer to pursue this on a “no win no fee” basis. You only pay us if we are successful
  • We deal with all aspects of the assessment and appeal process
  • If CHC funding is awarded retrospectively, we will calculate the reimbursement owing, including interest payments, and negotiate a settlement with the ICB to ensure the maximum entitlement is refunded

People often miss out on funding in many circumstances, including:

  • Being discharged from hospital straight into a care home
  • Those who were subject to assessment and found not eligible, but never reassessed as their condition worsened
  • Those who received Funded Nursing Care (which pays for the nursing element of their care), but were never assessed for CHC funding
  • More affluent patients who assumed they would have to pay. NHS Continuing Healthcare Funding is not means-tested: if you qualify, all your care is funded by the NHS

We felt more confident going into the review process with Farley Dwek on our side. After they attended the assessment meeting with us we secured the funding and we continue to save on the astronomical care home fees that we might otherwise have had to pay.

My sister and I have received absolutely first class professional support, guidance and advice throughout an extended period of time, seeking CHC on behalf of our mother. Every member of the team, with whom we had various communications with, were professional, courteous, and clear. The process is a challenging one and without their guidance, support and expert knowledge we would not have achieved the successful outcome that we did. We cannot recommend them enough.

The service I have received from Andrew Farley for a Continuing Healthcare Funding claim for my mother has been excellent. The initial contact with Andrew gave me a clear picture of the process, outlining timescales and explaining the stages that I would have to go through to achieve a successful outcome.

A sound investment! I had researched a number of firms offering assistance to help secure CHC funding for our Mum. I was very glad I chose Farley Dwek. Both my brother and I are retired solicitors and are able plough our way through regulatory material and legislation, However, neither of us had any experience in this area of law. I really appreciated Farley Dwek’s transparent and sensible advice. I would recommend doing the initial screening exercise with one of their nurses, we had the excellent Diane Jenkins for screening (and eventual support at the MDT).
