MDT Meeting

The family approached Farley Dwek Solicitors for advice following a Multi-Disciplinary Team meeting (MDT), which recommended their relative did not meet the criteria for NHS Continuing Healthcare Funding (CHC). We obtained care and medical records, which were reviewed by one of our specialist Nurse Assessors, who recommended the family appeal.

We lodged an appeal against the decision of ineligibility with the NHS Integrated Care Board (ICB), providing full Written Submissions in support, along with a copy of the evidence we had obtained.

While the ICB was considering the appeal, the patient’s condition deteriorated further, and it was agreed another assessment for CHC Funding was needed. Sadly, due to a significant delay on the part of the ICB, the patient passed away without any further consideration for CHC Funding.

Seven months after receiving our appeal, the ICB overturned its decision of ineligibility, without even convening a Local Resolution Meeting.

What a shame the ICB did not make the correct decision to award CHC at the initial point of assessment, saving the family much grief and expense, at a time when they should have been focused on their fragile relative.

"Farley Dwek persevered in a very old and difficult case on my behalf and were successful through tenacity and a refusal to give up, along with an in depth knowledge of the subject matter."

CHC client

"Andrew had a high degree of expertise in this field and was able to offer practical advice on how best to prepare an evidenced based case. He was also able to identify areas where the framework had been incorrectly applied. With this expert knowledge and guidance, we were successful in our appeal and the original recommendation of the DST was overturned. Our mother was awarded full CHC funding, backdated with payments refunded. The best £300 we ever spent!"

Jane

"Thanks to Andrew’s guidance, we were able to articulate and feedback our reservations to the CHC and they ended up ruling in our favour. We therefore did not end up having to formally instruct Farley Dwek for representation but our impression was that they were an exemplary firm with judicious invested leadership and noble ethics."

CHC client

"From first contact with the managing partner Andrew Farley and Ruth Pople, Senior Case Manager , Farley Dwek appeared to be a very well organised Law firm. The staff is very professional and takes all the time to explain sometimes complicated situations."

CHC client

"You don’t need any more worry about how to come up with the money at a time when you are trying to cope with the emotion and distress of trying to get the best care possible for loved ones. This needs sorting out and I’m glad Farley Dwek is on my side and helping through the process."
